Terms & Conditions

These Terms are an agreement between you and Formec Media LLP, the owner and operator of Wuggly ("Formec", "Wuggly", "we", "us" or "our"). They govern your use of Wuggly’s website, mobile app, connected toy, stories, voice features and related services (together, the "Service") in India. By creating an account, placing an order or using the Service, you agree to these Terms and our Privacy Policy.

If you do not agree, please do not use the Service.

You must be at least 18 years old and legally capable of entering a contract in India to create an account, buy a product or accept these Terms. The Service is designed for a parent or legal guardian to operate for a child; it is not intended for independent use or account creation by children.

You are responsible for supervising use by children, choosing age-appropriate stories and keeping the toy and device in a safe condition.

Give us accurate, current information and keep your login details confidential. You are responsible for activity on your account unless caused by our failure to use reasonable security. Tell us promptly at business@formecmedia.com if you suspect unauthorised access.

We give you a limited, personal, non-exclusive, non-transferable and revocable right to use the Service in India for private, non-commercial family use, subject to these Terms and any app-store rules that apply.

You must not:

• copy, resell, distribute, publicly perform or commercially exploit the Service or its stories;
• reverse engineer, bypass security, probe vulnerabilities or interfere with normal operation;
• use the Service to create unlawful, deceptive, abusive or infringing content;
• upload malware or attempt to access another person’s account or data; or
• use generated audio to impersonate, mislead, defraud or harm anyone.

You keep ownership of recordings and other content you submit. You give Wuggly a limited permission to host, process, reproduce and transform that content only as needed to provide, secure and support the features you request.

You may upload only your own voice or material for which you have all necessary permissions. Do not upload a child’s voice or another person’s voice without appropriate consent. You are responsible for your submissions and for how you use or share generated narration.

Formec Media LLP and its licensors own the Service, Wuggly branding, software, illustrations, story library and other supplied content. These Terms do not transfer that ownership to you. Feedback you voluntarily send may be used to improve the Service without payment, but we will not publicly identify you without permission.

Prices, taxes, delivery charges, subscription periods and renewal terms will be shown before you confirm a purchase. An order is accepted only when we send confirmation. Pre-order timing is an estimate and may change; if we cannot fulfil an accepted order, we will offer the remedy required by applicable law.

Payments and refunds may also be governed by the app store or payment provider you use. Any cancellation or refund terms shown at checkout form part of these Terms. Nothing here limits a non-waivable right or remedy under the Consumer Protection Act, 2019 or other applicable Indian law.

Wuggly supports bedtime routines but is not a medical device, childcare service or substitute for adult supervision or professional medical advice. Follow product instructions and age guidance. Stop using damaged hardware, cables or batteries, and keep charging components away from a child’s sleeping area.

Sleep, development and soothing results vary by child; we do not guarantee a particular outcome.

The Service may occasionally be unavailable for maintenance, security or reasons outside our reasonable control. Story selection, languages and features may evolve. We will not remove a paid core feature during its stated term without reasonable notice or an appropriate remedy where required by law.

You may stop using the Service and request account deletion at any time. We may restrict or suspend access where reasonably necessary to protect users or the Service, respond to legal requirements, investigate misuse or address a material breach of these Terms. Where appropriate, we will give notice and a chance to fix the issue.

We will provide the Service with reasonable care and skill. To the extent permitted by law, Formec Media LLP is not responsible for indirect or unforeseeable loss, loss caused by your misuse, unauthorised modifications, unsupported third-party products or events outside our reasonable control.

We do not exclude or limit liability where doing so would be unlawful, including liability for fraud, wilful misconduct, or rights and remedies that cannot be waived under Indian consumer law.

These Terms are governed by the laws of India. Please first contact us at business@formecmedia.com so we can try to resolve a concern promptly. You may also use any consumer grievance or dispute-resolution mechanism available to you under applicable law. Courts and consumer commissions with jurisdiction under Indian law may hear disputes.

We may update these Terms to reflect changes to the Service or law. We will post the revised Terms here and provide reasonable additional notice for material changes. Changes will not apply retroactively unless required by law.
